Terms of Use

1. Scope

These terms govern the use of the app "Spin." (hereinafter "Spin"), provided by 1020.dev e.U., Lichtenauergasse 4/8, 1020 Vienna, Austria. By registering, you agree to them. Apple's standard license terms for App Store apps (Apple Standard EULA) additionally apply; in case of conflict these terms prevail to the extent Apple permits.

2. The app

Spin lets you share one music track per day and view your friends' posts. Spin links out to Spotify for the full track. Spin plays no audio itself, does not control playback in Spotify, and does not provide full tracks. Spin is free of charge; you pay no money. In return for using it you provide the data described in the privacy policy.

3. Your account

Spin is for real people: you must be a natural person and register with truthful information. Automated accounts (bots) and impersonating another person are not allowed. One account per person. You must be at least 16 years old. You are responsible for keeping your credentials confidential and for activity under your account.

Contact matching: You may voluntarily let Spin search your address book for friends who are already using it. Only your contacts' email addresses are matched, and only as checksums, which we discard immediately after matching. If you transmit other people's contact details in doing so, you warrant that you are entitled to do so. You may only use the feature to find existing contacts — not to systematically collect third-party contact details or to advertise to others.

We do not store phone numbers. Until 6 September 2026 a phone number had to be provided at registration; it served contact matching only. That feature is gone: we ask for a number neither at registration nor in the profile, and every number already stored was deleted on 6 September 2026 — together with the checksums derived from it. So if you are wondering what happened to the number you gave back then: it is gone, and you need do nothing. Details are set out in the privacy policy.

4. User content and rules of conduct — zero tolerance

You are solely responsible for the content you share (captions, comments, username, display name, profile picture). A zero-tolerance policy applies to objectionable content and abusive behavior.

Reporting and blocking: in the app you can report objectionable content and block users. We review reports and act on legitimate reports within 24 hours by removing the content and/or suspending the responsible user.

Enforcement: depending on the severity and frequency of a violation, we may warn you, remove content without prior notice, and suspend your account temporarily or permanently. For severe violations (e.g. child sexual abuse material, threats of violence) we suspend immediately and permanently and, where required, report to the competent authorities. If we suspect a criminal offence involving a threat to the life or safety of persons, we inform law enforcement (Art. 18 DSA).

4a. How we moderate (Digital Services Act)

Spin stores content you share and is therefore a hosting service within the meaning of Regulation (EU) 2022/2065 (Digital Services Act, "DSA"). So that you know where you stand:

What we review and how

We do not review content in advance. A word filter automatically hides posts, comments and profile fields containing clearly prohibited terms from other users and puts them in front of a person for review; the content stays visible to you until a decision is made. All other content is reviewed when it is reported or we otherwise become aware of it. Every decision to remove content or suspend an account is taken by a person — not an algorithm.

Notices

Content can be reported in the app ("…" menu → Report) and — with or without an account — via the form at spin.1020.dev/report. A notice needs an explanation, the location (link), your name and email address (except for reports of child sexual abuse material) and a confirmation that the information is accurate to the best of your knowledge. You receive an acknowledgement and, after review, our reasoned decision by email. We handle notices in a timely, diligent and non-arbitrary manner; notices from authorities and courts are treated with priority.

Statement of reasons

If we remove or restrict your content or suspend your account, we tell you by email: which measure we took, the facts, whether the content breaches the law or these terms, whether automated means were involved, and how you can contest it (Art. 17 DSA). This does not apply where an authority orders the measure and prohibits notification, or where the measure concerns high-volume spam.

Complaints

If you believe a decision — a removal, a suspension or the rejection of your notice — is wrong, you can lodge a complaint free of charge within six months by emailing hallo@1020.dev. A person will re-examine the case and tell you the reasoned outcome. If the decision proves wrong, we reverse it. You may additionally turn to an out-of-court dispute settlement body certified under Art. 21 DSA, or to the courts. Complaints about our application of the DSA can be lodged with KommAustria, the Austrian Digital Services Coordinator.

4b. Misuse of the notice mechanism

Anyone who repeatedly submits manifestly unfounded notices or complaints may, after a warning, be excluded from the processing of further notices for a reasonable period (Art. 23 DSA). We take into account the number and proportion of unfounded notices, the gravity of the consequences and the apparent intent.

5. Grant of rights

You retain the rights to your content. You grant us a non-exclusive, worldwide, royalty-free right to store, display and deliver your content solely to operate and provide Spin, to the users you follow or who follow you. If you share a post or your profile via a link, we may show a preview (title, cover, caption, username, profile picture) on the linked web page to people without an account until you withdraw the post or delete your account. We may use feedback and suggestions you send us to improve Spin, without compensation.

Song of the day on our channels. We may feature any post you share as "Song of the day" on Spin's official social-media channels (currently Instagram). Shown are the song's title and artist, your username and — if you wrote one — your caption. We do not show your profile picture or any other data. For this you grant us a non-exclusive, worldwide, royalty-free right to make your caption publicly available on those channels; the rights to title, artist name and cover art remain with the respective rights holders. There is no entitlement to be selected and no remuneration. You can object to being featured at any time — in advance or afterwards — by emailing hallo@1020.dev; we then remove the post from our channels. Details on the data processing are in the privacy policy (section 5e).

6. Rights to the app

We grant you a personal, non-exclusive, non-transferable, revocable right to use Spin for private, non-commercial purposes. All rights to the app, its design and the "Spin." brand remain with us. Cover artwork and track metadata belong to their respective rights holders and are provided via Spotify.

7. Third-party services

Spin links to third-party services, in particular Spotify. The respective providers are responsible for their content, availability and terms; when you use them, their terms of use and privacy policies apply.

8. Availability, updates and changes to the app

We may change, limit or discontinue features where there is an objective reason (such as technical development, legal requirements or changes at third-party services) and this is reasonable for you. We provide the updates needed to keep the app in conformity (in particular security updates) and inform you about them via the App Store; if you do not install them, we are not liable for defects resulting solely from that (Section 7 Austrian Consumer Warranty Act, VGG). A daily song you have already shared, and its date, are immutable after submission; you can edit the caption afterwards and withdraw the post on the same day. Push notifications (e.g. the daily reminder) are optional and can be disabled in your device settings. There is no entitlement to uninterrupted availability; we strive for trouble-free operation.

9. Changes to these terms

We may change these terms, for example due to new features, changes in the law or changed moderation rules. We will inform you of material changes in the app in good time before they take effect; they only apply once you accept them there again. If you do not accept, you can no longer use Spin and may delete your account at any time. The current version is available at spin.1020.dev/terms.

10. Liability and warranty

The statutory warranty rules for digital services (Austrian Consumer Warranty Act, VGG) apply to defects of the app. Beyond that we are liable only for intent and gross negligence and for damages arising from injury to life, body or health; we are not liable for slight negligence to the extent the law permits. For content of other users we are liable, in accordance with Section 16 E-Commerce Act and Art. 6 DSA, only once we have knowledge of it.

11. Termination

You can delete your account at any time in the app (Profile → Settings → Delete account). We may suspend access in case of violations of these terms (see sections 4 and 4a, including complaints). We may delete accounts that have been continuously inactive for more than 24 months, after prior notice by email.

11a. Right of withdrawal

You may withdraw from this contract within 14 days without giving reasons. The period starts on the day of registration. A clear statement by email to hallo@1020.dev or by post to 1020.dev e.U., Lichtenauergasse 4/8, 1020 Vienna is sufficient; you may use the model form below but need not. Sending the statement in time is enough to meet the deadline. Since you pay no money for Spin, there is nothing to refund; upon withdrawal we delete your account and its content. You achieve the same effect at any time — also after the period — by deleting your account in the app.

Model withdrawal form: "I hereby withdraw from the contract I concluded for the use of the app Spin. — Registered on: … — Username / email: … — Date: …"

12. Governing law, dispute resolution, points of contact

Austrian law applies, excluding its conflict-of-law rules. Mandatory consumer-protection provisions of the country of your habitual residence remain unaffected. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration body; we prefer to resolve disagreements directly.

Our point of contact for users (Art. 12 DSA) and for authorities (Art. 11 DSA) is hallo@1020.dev; communication is possible in German and English. All mandatory disclosures are in the legal notice.
